Recapitulation
While the optional nature of the legal action does not raise any particular difficulties when it can be exercised by the holders of the right to act themselves, it may be otherwise when it is intended to be exercised in the name of and on behalf of others, in particular minors who generally do not have capacity to undertake litigation. The examination of the textual provisions which organise the representation of minors makes it possible to qualify the answer to the question of whether the representation of those persons who lack capacity to undertake legal proceedings is optional or compulsory. This article intends to deepen the reflection in order to be able to determine the respective areas of the ability to act and the obligation to act in representation of minors in a legal action.
