Recapitulation
The reconciliation of sustainability objectives and competition law has sparked a debate in light of the recent revision of the EU Block Exemption Regulations. While there is a wide consensus that addressing sustainability matters is vital for the successful “green” transition of the economy, there are divergent views as to how this transition can be achieved in alignment with competition law. Especially in more complex scenarios involving the cooperation of market players at different levels of the supply chain, novel questions arise that require in-depth competitive assessment on an individual basis. In any event, sustainable goals should not serve as pretext for “greenwashing” cartels. Likewise, the pursuit of sustainable supply chains which improve consumer welfare should not be hindered by competition law. The new draft EU Horizontal Guidelines could mark a new milestone when dealing with sustainability concerns at least in the area of horizontal cooperation. As the example of closed-loop supply chains shows, some forms of cooperation between firms can be considered necessary for a more sustainable development of the economy. Therefore, competition law should strike the right balance between adapting to the new changes in the “green” economy yet remaining vigilant towards the risks for competition.
